THE JUDGE in the AMD antitrust case ruled that sections relating to non US sales should be stricken from its complaint against Intel.
Intel had argued that allegations relating to foreign commerce could not be ruled on in a US court, citing numerous previous precedents.
Judge Joseph Farnan agreed with Intel lawyers, that allegations in paragraph 40-44, 54-57, 74-75, 81, 83, 96, 89, 93-94, 100-101 and 106 would be struck from the case.
In his opinion, the judge said that after considering AMD's case in a "light most favourable", he found that his court lacks jurisdiction over claims related to Japanese OEMs, European OEMs, and German retailers.
These formed a considerable chunk of AMD's original 428 page filing. However, AMD is also pursuing Intel in Europe and in Japan. This is a war of attrition. µ |
